Nearly two months ago Epic Games filed a lawsuit against Acceleration Bay LLC seeking declaratory judgment from the court in regard to allegations that Epic was using technology owned by AB in one of its many patents. Acceleration Bay filed a motion to dismiss on lack of subject matter jurisdiction (wrong court) as well as lack of controversy. In order to receive a declaratory judgment, a plaintiff must show the court that there is very likely to be a lawsuit over the matter. “The Court should dismiss this action because there is no immediate case or controversy between Epic Games and Acceleration Bay. Epic Games seeks declaratory judgment of non-infringement of seven patents owned by Acceleration Bay. But in the pre-suit communications that Epic Games alleges gave rise to this action, Acceleration Bay did not provide Epic Games with any claim charts or infringement analysis and Acceleration Bay did not threaten Epic Games with litigation. In BioWare’s newly published November update, General Manager Casey Hudson takes a look at what’s going on behind the scenes at the studio as the end of the year approaches. Yes, there are new (and unspecified) things going on with the Mass Effect and Dragon Age franchises, but right now, the primary focus is on the studio’s upcoming multiplayer shooter Anthem, which passed its alpha milestone back in September. “Now that we’re past our Alpha milestone,” Hudson writes, “we’re at the part of the project where we’re doing final tasks and changes, and doing a ton of testing and bug-fixing.” As part of this final stage of tweaking and polishing, the devs have recently gained access to Anthem’s play-from-home build: It’s a tradition at BioWare. If you’ve ever wandered through Booty Bay in World of Warcraft and thought that it’d be much cooler if the town featured a bunch of mannequins spouting gibberish and getting mad at one another for leaving dirty dishes in the middle of the hallway, you are probably a fan of The Sims 4. And now you can combine these two things with a complete recreation of Booty Bay in The Sims 4, right down to the exact placement of wooden crates. Yes, this is a thing. There’s a 40-minute video showing it off! Not only is this a cool video to watch, you can download and play around with the Sims-ified Booty Bay, as well as exploring other creations of user Sati Sim including Dalaran and the Darkmoon Faire. After the bombshell Kotaku article yesterday that revealed deep problems in the working environment at BioWare, studio General Manager Casey Hudson sent out an internal memo to staff acknowledging the article. He acknowledges that the issues are present and that "it's our top priority to continue working to solve them". Hudson then goes on to talk about efforts already underway to ease some of the top level concerns, but mentions that "there's much more to do". When I was offered the opportunity to return to BioWare as GM, I came into the role knowing the studio was experiencing significant challenges in team health, creative vision, and organizational focus.
